Short summary of the job:
The Afghanistan Access to Quality Justice Services (AQJS) project provides support to address the gaps and challenges in justice sector. Under the leadership of the Afghan Government institutions, the project’s expected outcome is to increase the access to quality justice for all and reduce the “justice gap” in Afghanistan with detailed objectives as follows; (i) increase access to justice for all through effective, accountable and gender-responsive justice & judicial institutions (ii) increase legal awareness of Afghan men and women (iii) strengthen linkages between formal and traditional/ customary / informal dispute resolution and (iv) strengthen justice institutions’ capacity to effectively implement the NJJRP. Consequently, Afghan men, women and girls can equally experience improved access to quality justice services and that would increase trust in Justice systems which is, in a longer-term, a key element to support economic development in the country.
The Afghanistan Access to Quality Justice Services (AQJS) under its output=I (AFGHAN CITIZENS, ESPECIALLY WOMEN AND GIRLS, HAVE IMPROVED ACCESS TO QUALITY JUSTICE SERVICES.) proposes programmatic engagement with the MOHE regarding development of Clinical Legal Education in the Universities.
In order to further foster systematic partnerships with MOHE and relevant Universities’ law clinics, UNDP/AQJS want to recruit defense lawyers to support the law clinic’s activities:
Background on Clinical Legal Education
In terms of the developing the Clinical Legal Education in the Higher Education, the Ministry of Higher Education , developed the new curriculum for the Law and Sharia Faculties, based on the new curriculum, the law clinic has been added as separate and an important subject in the curriculum for the fourth classes student of the law and sharia faculties. Based on article (3) paragraph (9) of the new Legal Aid Regulation, Law Clinic is a center where Law and Sharia students, after receiving practical legal trainings, provide legal aid under the supervision of a licensed advocate or professors of the mentioned schools who have license to practice. The licensed advocates at legal clinics provide free legal aid.
Under the overall direction of Law Clinic
Coordinator, Legal Aid Coordinator and Regional Coordinator, the incumbent will
be responsible to provide legal aid and legal awareness through law clinic’s
students and manage law clinic’s activities.
Duties and Responsibilities
Expected Outputs and Deliverables
Working under overall supervision of Law Clinic Coordinator, Legal Aid Coordinator and Regional Coordinator, the Law Clinic Defense Lawyer will work on the development and sustainability of the Clinical Legal Education and will be responsible for the following tasks:
· Provide free legal aid services particularly legal advices and legal representation through law clinic’s students to indigent clients and handling of 3 or 4 cases (felony and misdemeanor) per month in the court.
· Conduct specialized Practical legal clinical training for law students using real cases and simulations (for example in case law and legal analysis, legal terminologies, legal drafting, legal research and pro bono ethics)
· Organize public lectures with the participation of legal experts and public figures and law students
· Facilitate students to attend court proceedings to familiarize themselves with the court process
· Establish a specialized forum for female law students taking into consideration the gender sensitivities
· Contribute to annual law schools’ clinical legal education conference and be part of the law clinic network in Afghanistan in coordination with other law clinics and civil society organizations
· Handling and follow up of the clients’ cases in police departments, prosecution offices and courts through law clinic’s students.
· Support and assist law clinic’s legal awareness activities on district and village level.
· Teaching Law Clinics Guideline to the law clinic students which have been adopted and approved by the Ministry of Higher Education on 2017.
· Facilitate and coordinate law clinic access to AGO, Prison Courts in order to conduct interview with the clients and attend trail sessions.
· Develop practical training materials and conduct Practical legal trainings on applicable law to law clinic’s students and law clinic’s professors
· Provide technical and professional assistance to the law clinic’s students in writing indictment, defense statements, objection on court’s decisions and conducting defense investigation.
· Provide technical assistance and support law clinic’s students conducting mock trails.
· Maintain and Provide the complete soft and hard copy of the cases handled by the law clinic.
· Promote extracurricular activities and engagement in policy dialogue
· Assist the law and sharia Faculties developing law clinic’s subject’s context.
· Support data collection, documentation including the use of electronic database and reporting. Result based management approach that involve qualitative and quantitative data should be followed.
· Reporting on progress a monthly, quarterly and annual basis to UNDP AQJS Project technical staffs and legal clinic coordinator.
· Document the lessons learn from law clinic activities and sharing with UNDP AQJS project
· Providing some real experience what can be improved about the current Law Clinics
· Registering cases in the ALLAN database and CMS database.
· Perform any other tasks as required by the law clinic or is relevant to the Clinical Legal Education.

· Project implementation experience with the UN system is a strong asset;

· Fluency in Dari, Pashto and English is required
· University degree in Law/Sharia the preferred will be given to master. Also, the priority will be given to the defense lawyer from the provinces where AQJS project want to implement law clinic activities.
· Having a valid defense lawyer’s license.
· At least three years proven experience as a defense lawyer in a national or international organization, working experience in law clinics will be an advantage.
· Computer skills for performing tasks and reporting by email to the law clinic and UNDP AQJS.
· An understanding of the basic principles of rule of laws support, access to justice and Clinical Legal Education
· Ability to clearly express one’s thoughts, to analyse and present information clearly and concisely.
· Ability to set priorities and show initiative, to work independently and as part of a team.
· Strong organizational skills and attention to detail.
· Good interpersonal and communication skills.
